MINUTES

 

Chairman John P. Sivick called the meeting to order at 7:00 p.m.  Also present were Richard C. Vollmer, Vice Chairman, Paul D. Menditto, Supervisor, Atty. Robert F. Bernathy, William J. Greiner, P.E. and Robert H. Rohner, Jr., Secretary/Treasurer.

 

PUBLIC COMMENTS:

 

Scott Hanna commented on The November 19th snow storm.  He also requested an update on SR 2001.  Mr. Sivick replied that bidding date has been pushed back to August 2008.  Rep. Siptroth and Senator Baker will be notified.  PennDot has stated that there is a culvert problem. 

 

APPROVE THE MINUTES OF NOVEMBER 15, 2007:

 

Motion made by Mr. Menditto and second of Mr. Vollmer to approve the minutes of November 15, 2007 as presented.  Unanimous.

 

AUTHORIZE THE PAYMENT OF THE BILLS ON LIST #1, LIST #2 AND THE TRANSFERS AS PRESENTED:

 

Motion made by Mr. Vollmer and second of Mr. Menditto to authorize the payment of the bills on List #1, List #2 and the transfers as presented.  Unanimous.

 

DARE – SHERIFF’S DEPARTMENT:

 

Sheriff Bueki was present to thank the supervisors for their 2007 donation of $1,500.00.  It is a positive help for the children of the community.  DARE has implemented a DARE Curriculum and Gang Awareness program at the north schools.  The main function of a gang is to sell drugs.  Sheriff Bueki presented the township with two (2) signs that state “This is a DARE Community”.

 

OLD BUSINESS:

 

  1. STORM WATER MANAGEMENT PROJECT-WINONA FALLS ROAD

 

Tabled.

 

  1. PROPOSED ORDINANCE AMENDMENTS-ZONING, SUBDIVISION &

LAND DEVELOPMENT AND STORMWATER MANAGEMENT:

 

            Mr. Greiner has prepared a revised copy of the Zoning Ordinance as it

            relates to off premise special event signs, and outdoor furnaces.  A workshop will

           be scheduled with the planning commission.

 

NEW BUSINESS:

 

1.  LAND USE APPEAL NOTICE:

 

Atty. Bernathy stated that an appeal notice has been prepared as it relates to the Zoning Hearing Boards’ decision (approval granted) for James Pavlovsky of Pocono Mountain Lake Estates, Lot 130, Section 2 side yard setback request.  Atty. Bernathy believes that there have been certain errors of laws, and that the zoning board abused their discretion.  Atty. Bernathy recommends that the supervisors consider a move to enforce the integrity of the Zoning Ordinance.  Motion made by Mr. Menditto and second of Mr. Vollmer to file the appeal.  Unanimous.

 

MISCELLANEOUS:

 

  1. The Zoning Hearing Board’s hearing continuance for BGS Associates, LP’s request for a variance pursuant to Article 6, Off-Street Parking and Loading, Sections 601 through 604 of Ordinance No. 99 will be conducted on Tuesday, December 11th at 4:30 p.m. at the municipal building.  The property is the general store located on Rt. 209.  The supervisors directed Atty. Bernathy to attend.

 

ROADMASTER/PUBLIC WORKS DIRECTOR:

 

1.  MINK POND ROAD CULVERT PROJECT:

 

Tabled.

 

Mr. Sivick stated that the crew filled a pothole on Mink Pond Road.  Snow maintenance.  Mr. Sivick receives telephone calls from different sources when there is a need for winter maintenance.  The first couple of storms each winter are the worst for drivers, especially for new residents who are not familiar with driving in the country.  Park maintenance.  The engineers who will be doing work at the park have been approved by DCNR.  It is a requirement of the grant award.  Tree trimming throughout the township.  Maintenance on the vehicles and buildings.

 

Mr. Menditto thanked the Rev. & Mrs. Miller and the choir of the Bushkill Community Church for their contribution to the Christmas Tree Lighting Ceremony. 

 

Mr. Sivick added that PennDot’s claim that they would improve their winter maintenance on State roads has not happened.  In the last storm Rt. 739 in Delaware Township was not

touched.  It is the reason that Lehman Township took over the winter maintenance of SR 2001 and 2003. 

 

Also, the supervisors will be working with the Delaware Highland Conservancy on easements within the township.

Chairman John P. Sivick called the meeting to order at 2:30 p.m.  Also present were Paul D. Menditto, Supervisor and Robert H. Rohner, Jr., Secretary/Treasurer.  Richard C. Vollmer, Vice Chairman, Atty. Robert F. Bernathy and William J. Greiner, P.E. were not present.

 

PUBLIC COMMENTS:

 

None.

 

PUBLIC HEARING – ADOPTION OF THE 2008 BUDGET:

 

This was the date (December 18, 2007), time (2:30 p.m.) and place (Lehman Township Municipal Building) for the public hearing for the adoption of the 2008 budget for all funds.  The total for the General Fund budget is $3,216,010.00.  The total budget for all funds is $4,675,220.00.  No public comments were received.  Motion made by Mr. Menditto and second of Mr. Sivick to accept and adopt the 2008 budget as presented.

Motion made by Mr. Menditto and second of Mr. Vollmer to approve the minutes of December 5, 2007 as presented.  Unanimous.

 

APPROVE THE MINUTES OF DECEMBER 18, 2007:

 

Motion made by Mr. Menditto and second of Mr. Vollmer to approve the minutes of December 19, 2007 as presented.  Unanimous.

NEW BUSINESS:

 

  1. HIGHLAND VILLAGE MASTER PLAN CONDITIONAL USE APPROVAL-EXTENSION OF TIME REQUEST:

 

Mr. Sivick stated that Atty. Bernathy had reviewed the request by the developer for an extension of 180 days as it relates to the Master Plan and Conditional Use Application; specifically, Section II, Paragraph 17 and Section II, Paragraph 21.  Motion made by Mr. Vollmer and second of Mr. Menditto to grant an extension of 180 days.  Unanimous.

 

ADDENDUM NO. 1:  Mr. Sivick stated that an Open Space Plan needs to be prepared so that the township can qualify for grants awarded by the county.  The company of Simone Collins; who has done work for the township in the past, will be able to assist the township.  Motion made by Mr. Menditto and second of Mr. Vollmer to hire Simone Collins to prepare an Open Space Plan for the township.  Unanimous.

 

MISCELLANEOUS:

 

  1. The 2008 Budget for all funds was adopted on December 18th.  The total General Fund Budget is $3,216,010.00.  This is an increase of $28,424.00.  The budget for all funds totals $4,675,220.00.  This is an increase of $272,362.00.  There will be no tax increase.

 

ROADMASTER/PUBLIC WORKS DIRECTOR:

Mr. Sivick stated that the crew has been busy with winter maintenance on the roads.  A building at the community park has been demolished.  Preparation work at the park for the construction of new ball fields.

MINUTES

 

Chairman John P. Sivick called the meeting to order at 3:30 p.m.  Also present were Richard C. Vollmer, Vice Chairman, Paul D. Menditto, Supervisor and MaryAnn Conza, Administrative Assistant.

 

PUBLIC COMMENTS:  None.

 

POLICE STUDY REPORT:  Representing the Police Committee were Tom Scheffel, Donald Jablonski, Ed Burmeister and Vic Raimond.

 

The committee submitted an alternate proposal for a smaller force that will give enough patrol officers to start with and will be built up within the near future.  A copy is part of these minutes on file.

 

Mr. Vollmer commented that three experienced officers is not enough.  There should be half experienced and half probationary. 

 

Mr. Menditto stated that the $1,000 salary difference between the experienced officers and the probationary officers does not seem fair.  Average salaries within the State were then discussed. 

 

The total number of tax payers for the Township will be difficult to get because of taxing variations. 

 

The figures in the start up costs are incorrect.  Also, the cost for the building does not include any finance costs. 

 

More work on the report needs to be done before a public meeting. 

 

ROAD SALT:   Mr. Menditto made a motion allowing the Township to purchase salt, in an emergency, above the Council of Government’s bid price because of the difficulty in getting timely deliveries from the vendor.  Seconded by Mr. Vollmer.  Unanimous.
