MINUTES: REGULAR MEETING
Chairman John P. Sivick called the meeting to order at 7:12 p.m. Also present were Richard C. Vollmer, Vice Chairman; Paul D. Menditto, Supervisor, Atty. Robert F. Bernathy, Township Solicitor and Robert H. Rohner, Jr., Secretary/Treasurer. William J. Greiner, P.E., Township Engineer was not present.
PUBLIC COMMENTS:
No comments were received.
APPROVE THE
MINUTES OF DECEMBER 16, 2009:
Motion made by Mr. Menditto and second of Mr. Vollmer to approve the minutes of December 16, 2009 as presented. Unanimous.
AUTHORIZE THE
PAYMENT OF THE BILLS ON LIST #1, LIST #2 AND THE TRANSFERS AS PRESENTED:
Motion made by Mr. Vollmer and second of Mr. Menditto to authorize the payment of the bills on List #1, List #2 and the transfers as presented. Unanimous.
ACCEPT THE
FINANCIAL STATEMENTS; ALL FUNDS, FOR THE MONTH ENDED NOVEMBER 30, 2009:
Motion made by Mr. Vollmer and second of Mr. Menditto to accept the financial statements; all funds, for the month ended November 30, 2009. Unanimous.
OLD BUSINESS:
Mr. Vollmer stated that the system had been tested by Allstate Septic Systems and
the tests have proven that the system has not failed. There are three (3) bedrooms in the house. Correspondence dated December 30, 2009 has been forwarded to the Larkins stating that the three (3) test holes dug for the tests must be filled in before the septic permit will be re-instated. Motion made by Mr. Vollmer and second of Mr. Menditto to re-instate the Larkin’s septic permit conditional upon the three (3) test holes being filled in. Unanimous.

2. PENNDOT – BENSLEY FAMILY
ESTATE PROPERTY: DANGEROUS
STRUCTURES:
Motion made by Mr. Menditto and second of Mr. Vollmer to schedule a
Dangerous Structure Hearing for Wednesday, February 3, 2010 at 7:05 p.m. for
the property
owned by PennDot on
NEW BUSINESS:
Correspondence dated January 4, 2010 had been received from the Bushkill
Historical Society. The Society is requesting permission to set up a display in a
building located within the community park.
Motion made by Mr. Menditto and second of Mr. Vollmer to approve this request,
and that the Society will hold the Township harmless. An indemnification
agreement for storage will be prepared by Atty. Bernathy. Proof of insurance
will be obtained from the Society. Unanimous.

WORKS DIRECTOR:
Mr. Sivick stated that the crew has been busy with winter road maintenance. Maintenance to the vehicles. Repairs and maintenance at the community park.

BUSINESS:
1. MINOR SUBDIVISION – THE LANDS OF JOSEPHINE VAN WHY:
The plan is a revision to a previously approved subdivision which was recorded in the Pike County Recorder’s Office. The original plan was prepared in 2006, but did not include a prior conveyance between Josephine Van Why and Rodney Kimminour. This plan corrects that mistake. No other changes are proposed on the plan.
The Planning Commission has recommended approval and the County comments have been addressed.
Motion made by Mr. Menditto and second of Mr. Vollmer to approve the revised plans. Unanimous.

NATIONAL
PARK SERVICE:
Motion made by Mr. Vollmer and second of Mr. Menditto to send a correspondence to the National Park Service asking them to consider entering into a partnership with Lehman Township to make land around the Heller property available for a garden for the residents. Unanimous.
MISCELLANEOUS:

Motion made by Mr. Sivick and second of Mr. Menditto to table the request until the days requested are reviewed between Bushkill Youth Association and the E. Stroudsburg Little League North. Unanimous.
