Vice Chairman Richard C. Vollmer called the meeting to order at 10:00 a.m.  Also present were Paul D. Menditto, Supervisor and Robert H. Rohner, Jr., Secretary/Treasurer.  John P. Sivick, Chairman; Robert F. Bernathy, Township Solicitor and William J. Greiner, P.E., Township Engineer was not present.

APPROVE THE MINUTES OF AUGUST 7, 2011:

 

Motion made by Mr. Menditto and second of Mr. Vollmer to approve the minutes of August 7, 2011 as presented. 

 

APPROVE THE MINUTES OF AUGUST 26, 2011:

 

Motion made by Mr. Menditto and second of Mr. Vollmer to approve the minutes of August 26, 2011 as presented.

MINUTES

 

Chairman John P. Sivick called the meeting to order at 10:00 a.m.  Also present were Richard C. Vollmer, Vice Chairman; Paul D. Menditto, Supervisor; Robert F. Bernathy, Township Solicitor; William J. Greiner, P.E., Township Engineer and Robert H. Rohner, Jr., Secretary/Treasurer.

2012 MINIMUM MUNICIPAL OBLIGATION FOR THE TOWNSHIP’S PENSION PLAN IS $53,862:

 

Mr. Sivick announced the township’s obligation for 2012.

 

GTS – ADDITIONAL SERVICES, COMMUNITY PARK:

 

Additional test pits will be conducted by GTS.  Mr. Greiner stated that their numbers are the norm.  Township equipment will be used, and operated by township employees.  Motion made by Mr. Menditto and second of Mr. Vollmer to approve the additional services.  Unanimous.

 

STORM DAMAGES AND REPAIRS:

 

Mr. Greiner will determine the additional damage done to township roads and the community park by last week’s heavy rains attributed to Tropical Storm Lee. 

 

The supervisors have a concern, and directed Mr. Greiner to review the culvert being placed on Brodhead Road by Leeward Construction for PennDot’s upgrade of SR 2001.  Mr. Greiner’s review comments will be forwarded to PennDot’s District 4’s engineering and maintenance departments.

 

Mr. Greiner was directed to review Creek Road and the damage done at the bridge.  The township will need to obtain a permit.

 

The supervisors will review with the township’s emergency management director on how to improve the township’s responses and communications.

 

Mr. Sivick questioned Mr. Greiner regarding PA DEP’s willingness to issue an emergency permit for 30 days for the drainage repairs on Winona Falls Road that caused the land slide in the park.  Will the township be able to get an extension if needed?  Mr. Greiner will contact

PA DEP.  Based upon the Governor’s declaration of a State of Emergency, the township will not have to go through the bidding process.  Mr. Bernathy stated that pursuant to the Second Class Township Code, Section 3102; pertaining to emergencies, contracts or purchases in excess of $10,000 are not required to be put out for bid. 

 

Motion was made by Vollmer and second of Mr. Sivick confirming that the supervisors had declared at State of Emergency on August 26, 2011 at 2:30 p.m. in anticipation of Hurricane Irene.  Unanimous.

Motion made by Mr. Menditto and second of Mr. Vollmer to award the bid for gabion rock, crusher run, 3A stone and blacktop-cold patch to 209 Enterprises, and award the bid for blacktop to Eureka Stone Quarry, Inc.  Unanimous.

 

EMERGENCY REPAIR PERMIT – WINONA FALLS ROAD:

 

Mr. Greiner will move ahead to obtain the permit for the repair to Winona Falls Road.

 

MINK POND ROAD CULVERT PROJECT – LETTER OF CREDIT RELEASE:

 

Northeast Site Contractors has completed its obligation to the township.  The township holds a Letter of Credit in the amount of $86,900.  $78,370.52 can be released to the contractor with a new Letter of Credit to be issued in the amount of $8,529.48 (10% contract value).  The expiration date of the new Letter of Credit and the maintenance guarantee period will be 18 months from May 6, 2011 or November 6, 2012.  Motion made by Mr. Menditto and second of Mr. Vollmer to release $78,370.52 to Northeast Site Contractors.  Unanimous.

 

ROADMASTER/PUBLIC WORKS DIRECTOR:

 

Mr. Sivick stated that the crew has been busy with repairs to roads and culverts damaged by Hurricane Irene and Tropical Storm Lee.  The road repairs at the bridge on Creek Road are near completion.  The land slide in the community park has been stabilized.  Repairs to the shoulder damage on Mink Pond Road.  All fallen trees on Brodhead Road

have been cleared.  An evaluation is being made to the repairs that must be done before the road can open.  A meeting will be scheduled with PennDot and Leeward officials to discuss the culvert being placed on Brodhead Road, and why it has not been completed.  Mr. Greiner recommends upgrades to the culverts on Brodhead Road.  Mr. Greiner will look at how to by-pass the water from not just going under the road.
